Filed Chapter 13 jointly, spouse has died, what now?

My husband and I filed Chapter 13 and now my husband has passed away. It’s only been a week or so. The only income that I have now is a Soc. Sec. check for my son who is almost 17. I am not old enough for widows benifits until Nov. I am not working as my husband was so sick and I had to care for him at home. I did not have enough credits to get my own soc. sec. I do not have enough income to continue an $1800 a month payment to the bankruptcy court. It seems my only salvation temporarily is a possible disability check that would be retroactive to July. I believe I owe only about $9,000. I am doing my tax return today and will make a copy of it and attach the death certificate, and send it along to either the attorney or the trustee, I am not sure which to send it to. Is their any relief in the law for this kind of situation. The only assets are my home and car and contents of our house. We had no insurance of any kind. I would appreciate any help with this….Thanks so much!

can you mortgage your house or business to pay a funeral – friends mom just died unexpected?

friends mom just died – the dad found her sitting in a chair dead. They own 3 buildings (business buildings – but not rented out however in prime section) and a house – however they have bad credit.They did not carry mortgage insurance. I dont know what to tell this friend as she is devasted from this. They need almost 10,000. None of the buildings are paid for either and the dad only gets social security. I thought maybe they could mortgage the house or something to handle the cost but I dont know. I personally have life insurance to cover this kind of stuff. Anybody have a clue as to what to do here or suggest?

If Dad died would Mom still have good credit?

Okay, morbid thinking. My parents have life insurance but from what I know they just have joint bank accounts. So if Dad died and Mom wanted to refinance the house or something, would she be able to do that or does the 20+ years of excellent credit count for nothing because Dad was/is the primary card holder with Mom as the authorized user which I believe is the arrangement.

Would Dad’s dead credit be excellent and Mom’s at virtually nothing by comparison or would the good credit card payments be reported on Mom’s report as well?

Indiana.Wife Died Approved for a home I can afford, can I buy it, and let the 1st foreclose and keep the new?

I can not afford where I are currently living. I originally bought this house 3 years ago. My wife died in 2006, we had no insurance on her. The payments are to much for me alone.

I have been approved for another loan. I know all about it ruining my credit but can I keep a new house if I do buy another and let the one I am currently in go thru foreclosure?

I can not sell it due to the current market and location of this doublewide. There is no equity in this Doublewide.

The payments are current at this time, and that is why I applied for another loan and was approved.

Would I be able to keep the new house without fear of it being took etc?

I have tried over the past year to sell this, etc. and it will not sell. I have spoken with the bank, and tried to get a refinance to lower payments, with no results.

I have found a house I can afford, and at the same time try to save my emotional self by no longer living in this house where she died.

Can I do this or not?
